Hemvisttidens beräkning vid ansökan om svenskt medborgarskap
Hi , I'm planning to apply for the swedish citizenship soon , I read online that the minimum time to live in Sweden is five years for persons who have the permanent residency permit besides other issues.
The question is that I am fully aware of all requirements but :
Since the waiting time to get my application examined is approximately not less than 10 months at least ( normally it can take up to 28 months before getting the case examined according to the migrationsverket website) then I am thinking of applying little bit earlier..I'm living in Sweden for and half years ago wity the PUT and planning to stay here since I'm working.
The question is :
When the migrationsverket starts examining my application: they will look at the time when that application was placed ? To determine the duration of staying ?
Why not to apply earlier so I can get my application registered on the system queue earlier then I can have the waiting time registered in the Q.. shortening the time to get a decision . Thx .

The rules on Swedish citizenship can be found in the Citizenship Act (medborgarskapslagen). In your case the applicable provision is 11 § 4c. The calculation of domicile time according to this provision has been tried by the Migration Court of Appeal (Migrationsöverdomstolen) several times, for example in MIG 2013:22. The court has hereby established that the assessment of the domicile time shall be based of the prevailing circumstances at the time of examination (prövningstillfället) of the case. This means, that the domicile time will be assessed by the Migration Agency (Migrationsverket) when they examine your case, i.e. not when the application was placed.
Summary
To sum up, you can apply for Swedish citizenship even if you yet haven't fulfilled the domicile time of five years. To be on the safe side though, I would recommend you to contact the Migration Agency before you hand in your application so that you're completely sure that it will be fine.
