Work permit and spouse's residence permit / Arbetstillstånd och makes uppehållstillstånd

Question

Hi , I have get married with a woman who has been livng in Sweden for two moths illegaly. She is third country citizen . I am also thrid country citizen but I have temporary work resident permit and also i have a unlimited work contract in Sweden. Now I would like to get informed how legally my wife could enter Sweden and how the transgression of the visa law can affect us???

Thank you for sending your question to Lawline.

As you have a work permit in Sweden your wife can apply for a residence permit that extends for the same period of time. This will have to be done at the Swedish embassy or consulate general in her home country prior to travelling here. If your work permit lasts for a period of six months or longer your wife can also apply for a work permit. Once you have had work permits for a period of two years you can both apply for a permanent residence permit.

Eftersom du har ett tillfälligt arbetstillstånd kan din fru ansöka om ett tillfälligt uppehållstillstånd i Sverige som gäller för samma tidsperiod som ditt arbetstillstånd. Ansökan måste dock göras från den svenska ambassaden i din frus hemland innan hon reser hit. Om ditt arbetstillstånd uppgår till sex månader eller mer kan din fru också ansöka om ett arbetstillstånd. Efter två år kan ni sedan ansöka om permanent uppehållstillstånd.
