What to do when the other parent abuses the child?

Hi,

i need your help to find the kap § number or article code in the swedish law (brotts balken ) for a brott / stämning against my wife and her family.

My wife and her parents are alcoholic and they were letting/offering my 18 month daughter to drink the left over of their beer bottles ( Alkoholhalt 5.3%) when i was outside the country.

I've discover that later ...

That was the fastest way to put her to sleep....

First of all, every child is entitled to care, safety and a good upbringing. Children shall be treated with respect for their person and individuality and may not be subjected to bodily punishment or any other humiliating treatment (6 kap. 1 § föräldrabalken (FB)).

The actual crime that your wife and her family have committed is called "misshandel" in swedish and it is equivalent to assault/battery in english (3 kap. 5 § brottsbalken (BrB)). Their blameworthy act of giving the child alcohol, may have caused him/her physical injuries. Otherwise, they have rendered the child unconscious, with the intention of making him/her fall asleep, which is also included in the same paragraph.

If any of the parents abuses the child or otherwise acts improperly, the parent may be deprived of him/her (6 kap. 7 § 1 st. föräldrabalken (FB)). If the parents have joint custody of their child and if one of them is unsuitable as a guardian, the court shall assign custody to the other, unless he or she is unsuitable as well (6 kap. 7 § 2 st. FB). If the (abusing) parent has sole custody of the child, the court shall, in cases referred to in the previous paragraph, transfer the custody to the other parent or, if more appropriate, to one or two specially appointed custodians (6 kap. 7 § 3 st. FB). Here the situation depends on if you have custody of the child and if you are appropriate as a guardian.

Advice

My first advice to you would be that you, if you have not yet, take the child to the nearest emergency center for evaluation. Secondly, you should contact the police (call 112) and simply explain the situation. You are not required to have any background knowledge of the convicted crimes.
