Possibility for shared custody

Hi,

first, I'm so sorry to write here in english, I do not master swedish well enough, but I am learning.

Here is the situation : I french and my girlfriend is swedish. She has 3 kids, and here ex (non-married) told her than if she leaves him, he would take the kids away from her. She has a depression, but is on medication and feels really better, even if the situation doesn't help, and has issue with alcohol. She is working on it, and already successed to quit, but, once again, living with her ex, making her emotional made her fell back. The things is, she never drinks in front of the kids, and take care of them alone when her ex his working, without any troubles.

Anyway, my question is, does he has the right to prevent her to see them again if she leaves him ? Could she gets a shared custody, or at least a right of visitation, if she success to stay sober - to stay sober when she is with the kids ?

I will try my best to answer your question in english, below will follow an identical answer in swedish if you want to practice. Unfortunately the links are in swedish.

Custody
If the parents aren't married at the birth of the children the custody will automatically go to the mother, which probably also was the case for your girlfriend and her ex if they weren't married at the time. Although I presume that they changed the custody to a shared custody. I assume that they today have shared custody of the children.

Regarding the children's living conditions, the custody and the right to access, it is always what is best for the children that is crucial for the decision, see "6:2a "föräldrabalken". If one of the parents want to change the custody of the children they can either write an agreement between themselves, for an agreement like this to be approved it has to be in writing and approved by the social board, see 6:6 föräldrabalken. They can also turn to the district court so they can make a decision. In the court's decision regarding the custody they will particularly take into account if the parents can cooperate regarding the children. If the court believs the parents can cooperate there is a bigger chance that the court decides for shared custody, see 6:5 föräldrabalken. The court can also decide for change in the custody if the children or child is being neglected or a parent in any other way deficiencies in care if this entails danger for the child's growth or health, see 6:7 föräldrabalken.

It is difficult for me to give you an answer regarding your girlfriend's chances to a shared custody of the children. As said before, it is what is best for the children that is the decisive thing for the decisions, it is also important that your girlfriend and her ex can cooperate regarding the children. Thus your girlfriends ex har no right to prevent your girlfriend from seeing her children just for the sole reason that she leaves him. They will still have shared custody and if he wants to change the custody he either has to take it to court or make an agreement with your girlfriend. Of the little information that I have I would guess that shared custody is possible but in the end it is up to the parents or the court.

Right of access
If they together or the court decides that the father will have custody alone or if the children will live with their father, the children have the right of access to your girlfriend. It is the samt for the right of access as the custody, the decisive thing is what is best for the child, see 6:2a föräldrabalken. A child always has the right of access to a parent that the child does not live with, see 6:15 föräldrabalken. It is important to point out that the right of access is for the child and not for the parent, there is no duty for the child to meet his/her parents and no right for the parent to meet her/his child. The parents has a mutual responsibility to make sure that the right of access between the child and the parent is met. If one of the parents feels that the right of access is not met, he or she can either turn to the district court or the social board and ask them for a decision regarding the access right. The parents can also instead write an agreement that the social board has to approve, see 6:15a föräldrabalken.


If the children will not live with your girlfriend they will have the right of access to their mother. If it is not harmful for the child to be with that parent it is desirable that the right of access of both of the parents for the child is met. Your girlfriend can go to the social board or the district court if she believes that the right of access is not met. I cannot see any reason that the court would decline this right, thus it is not possible for your girlfriend's ex to prevent your girlfriend from meeting her children, although I know little of the situation. In the end it is always the court or the parents and what is best for the child that is crucial in the decision.

Vårdnad
Om föräldrarna inte är gifta vid barnets födelse går värden om barnet automatiskt till modern, vilket också var fallet för din flickvän och hennes ex om de inte var gifta vid barnens födelse. Dock antar jag att de ändrade vårdnaden så att den idag är delad gällande alla barnen, det är detta jag kommer utgå från.

Gällande barnets boende, umgänge och vårdnad är det alltid vad som är bäst för barnet som ska vara avgörande för beslutet, se 6:2a föräldrabalken. Det är rätten som beslutar om vårdnaden om en av föräldrarna vill ha ändring i vårdnaden. Vid detta beslut tar rätten särskilt hänsyn till om föräldrarna kan samarbeta gällande barnen, om de kan det är chansen större för gemensam vårdnad, se 6:5 föräldrabalken. Föräldrarna kan också på egen hand avtala om att vårdnaden ska vara ensam eller gemensam, detta avtal måste vara skriftligt och godkännas av socialstyrelsen, se 6:6 föräldrabalken. Rätten kan också besluta om ändring i vårdnaden om barnet/barnen försummas/missbrukas eller en förälder på annat sätt brister i omsorgen om sitt barn om detta medför bestående fara för barnets hälsa eller utveckling, se 6:7 föräldrabalken.

Det är svårt för mig att svara på din flickväns chanser till gemensam vårdnad om sina barn. Det avgörande i sådana här beslut är alltid barnens bästa, det är också viktigt att din flickvän och hennes ex kan samarbeta kring barnen för att de ska kunna ha gemensam vårdnad. Din flickväns ex har alltså ingen rätt att hindra din flickvän från att träffa sina barn endast för att hon lämnar honom. De har fortfarande gemensam vårdnad och om han vill ändra den får de antingen avtala om detta gemensamt eller så får han gå till tingsrätten. De tar sedan ett beslut som kommer grunda sig på vad som är det bästa för deras barn. Av det lilla jag vet skulle jag möjligtvis gissa på att delad vårdnad är möjligt, men det är endast en gissning från min sida, det är tingsrätten som avgör.

Umgänge
Om de tillsammans eller tingsrätten kommer fram till att fadern ska få ensam vårdnad om barnen kommer din flickvän ha rätt till umgänge med barnen. Samma som med vårdnaden så är det barnens bästa som är avgörande för beslut rörande umgänge, se 6:2a föräldrabalken. Ett barn har alltid rätt till umgänge med en förälder som barnet inte bor med, se 6:15 föräldrabalken. Viktigt att komma ihåg är att umgänge är till för barnet och inte för föräldern, barnet har ingen plikt att träffa sin förälder och föräldern har ingen rätt att träffa barnet. Föräldrarna har ett gemensamt ansvar att umgänget mellan barnet och den ena föräldern tillgodoses. Om ena föräldern känner att umgänget inte tillgodoses kan denna gå till tingsrätten eller socialnämnden och be dem besluta om umgänge mellan barn och förälder, föräldrarna kan också skriftligt avtala om umgänge om socialnämnden godkänner avtalet, se 6:15a föräldrabalken.

Om det blir så att barnen kommer bo med din flickväns ex har alltså barnen fortfarande rätt till umgänge med sin mamma. Om det inte är skadligt för barnet brukar man så långt som möjligt vilja tillgodose barnens behov av umgänge med båda föräldrarna. Din flickvän kan alltså alltid gå till socialstyrelsen eller tingsrätten om hon anser att barnens umgänge med henne inte blir tillfredsställt. Jag kan inte se någon anledning till att pappan skulle kunna förhindra umgänge i detta fall, dock vet jag som sagt inte mycket om situationen, Återigen är det alltid barnens bästa som är avgörande i besluten.
